Is the society maintenance charges payable from date of agreement, completion or possession?

Hello Sir,

I bought a almost ready possession flat in Pune. I did agreement to sale around 29th Nov 2012. After all the other formalities and other payment completion got the possession of the flat around 19 Feb 2013.

Do I need to pay maintenance charges from the agreement date or from the date which I got possession i.e. from 19 Feb 2013 ?

    In your case, you should pay the maintenance from date of agreement.

    We have 3 buildings in our premise.
    Each building is a separate society.

    Building a , b have same number of flats while building c has double the number of flats. Now there is a federation of all the three societies. My question is about the common area maintenance.

    Is there a rule that each society will contribute equally to the maintenance despite of number of flats per society?

    Federation should charge based on number of units.

    I have purchase a flat in BHARAT CITY, Loni Road, Ghaziabad, developing by BCC infrastructure Pvt Ltd.
    Now, the BCC started to offering possession and some of around 70-75 owners shifted in the society in last 2 months. The common areas are still not developed properly and builder is still working on other towers.

    Now, builder sent us to pay common area maintenance charges 1.68/sqft.

    Is this the rule that builder maintain the society using interest from IFMS deposited by builder till 2 years. Please please suggest.

    Dear Surendra,

    One needs to see your agreement clause before commenting. All depends on the terms you have agreed in the agreement you have signed with the builder. Unfortunately, most people do not read those document thoroughly and do not take some clause seriously at the time of purchase. Suggest your seek advice from a local legal advisor.

    Hi, I have booked an under construction flat a year couple of years back. 75% of its work is completed as per schedule given by the builder. For the remaining 25% he told me that it will take another one and a half year. My pre-emi is also started. How can I avoid paying my pre-emi to bank for next couple of years? He is deliberately delaying to complete his project on time for which I am paying penalty by paying pre-emi to bank.

    i have this same question. Why am I supposed to pay for maintenance unless possession (not residing) is acquired.
    My agreement month is July 2011. I have paid 3 months advanced maintenance to builder. The possession letter is of Sept 2011. SO should i should be entitled to pay from Dec 2011.
    Kindly answer.
