Can housing society management charge on water supply?

Dear sir,

I was searching for a site where I could get answer to my questions too.

Our society is 5 yrs old approximate. Due to less water supply and more residents adding by the year the society management staff has installed individual water meters and has set a limit of 420 liters free per day n above that the water will be charged as per 0.15 paisa per liter irrespective of how many people stay in the house.

Is it legal for the management members to charge on water which is free PCM water? And also set a limit on their own?

The society has 90 houses (row houses) and the area of each house is around 2000 sft. and the occupancy is 60 units.

Please advise.

    Firstly, note that PMC charges for water is already included in the annual PMC tax bill. Hence, society cannot bill for PMC water.

    However, if water tankers are being procured, cost must be shared amongst all members. Calculation is: cost of water tanker divided by number of inlets multiplied by inlets per unit. Example: 2 BHK may have 4 water inlets but 3 BHK may have 5.

    Billing on water meter is not legal nor a correct mode of collection. You can seek written explanation for this society rule from your society managing committee and then approach the cooperative deputy registrar of your area with your complaint.

    There is negligible water supply from PMC. Water is being extracted from society borewells. The actual expenses of pump electricity bills are taken care of through maintenance. Water is being charged for by use of meters installed. Committee says that it is legal to charge since they will create a "water fund" with this money.
    Is this legal if a fund is being created?
    Tenants are also being charged for creation of this society fund - is that legal?

    Dear sir.

    We all had a meeting yesterday where the tenants were also a part for the first time.
    The management committee says since the problem of shortage of water will arise in future, they wish to collect this money which they r charging all for water as reserve n use in future for water tanker.

    They wish to name it as water fund. As per the bylaw 65 society act they say it is legal to charge the water .(..pmc n borewell ) n use the money when required.

    Sir please suggest if the procedure is correct.

    Yes, society can bill for water if procured. One has to bill per inlet on additional water.

    Society has set limit of 420 liters per house based on government guidelines published per user as 70 to 90 liters per day. This 420 liters is only for good drinking water usage. For toilets,flush systems and common garden area society already have STP plant and that water is not charged at all. flats who has more than allocated usage of 420 liters are being charged per liter as per tanker charges. Today society is using bore-well water but wants to limit those flats who are using excessive water and above government set limits. Society hardly gets 5000 liters from PMC for 90 flats and daily usage is more than 50,000 liters. society MC mentioned that who ever is using or wasting more water should either control the usage or pay as they use. This is in anticipation that bore-well water has no guaranty for how long it can be procured and in situation where only few flat holder's who are using excessive water then they should pay as they use today since due to these houses there will be water shortage very soon than if they use in control. If all owners and tenants uses water sparingly and not waste then i don't think we will have to pay for excessive water usage. But why should anyone pay for bore-well water ? and other side of people has argument that because some houses using or wasting more water than set limit and then why they suffer if they use within limit and pay for these excessive usage households when bore-well will dry and tankers has to be procured.
    Please advise if this is legal and right way of controlling water usage or is it something wrong in society norms? PLEASE HELP.

    Sir,
    We are paying water charges due to us on quater basis to BMC on bill raised by them, inspite of that society continuously charging water tax in there maintenance bill and we only posses one line. please help us on how to tackle this either we pay maintenance bill after deducting water tax already paid to BMC against bill OR pay both BMC as well as Society

    BMC charge us Quaterly 1600
    Society charges us Quaterly 3000

    Hi Sir,
    If a flat which is locked for years should also be part of the EXTRA water payment which Society arranges through water tankers?
    In Pune we have water crisis hence we need to call water tankers to over come water issues.

    Our society is recently established. The PWC members are nonfunctional since the establishment I.e. since last 4 months. Even they have not created the mom of first meeting which is being taken by builder while doing the handover of society. Also PWC members has still not taker the bank out from builder.

    Could you please tell us what exactly we have to do? Could you please explain step by step what we have to do as we all I.e. PWC n all other flat owners don't know what we have to start with. As per my knowledge I think first PWC has to first send the builder's meetings mom to all society members. Isn't it.

    Please help us.

    Dear Sir,
    Society has been formed & registered , but one time maintenance amount which all members had already paid to builder has not been credited to society. My question is Chairman is asking for monthly maintenance amount & I denied to pay unless receipt of 1 times maintenance amount from Builder, Please suggest the correct action.
